Hyderabad: In a significant development in the phone-tapping case, cancellation of Indian passport of former SIB chief T. Prabhakar Rao has shattered his hopes of a Green Card application in the US, making his possible deportation to India relatively easier. With a Red Corner notice already issued against him and flashing of his particulars in 196 countries, the latest development may further impact his status in the US, a senior police officer said. The Telangana police in coordination with Interpol are working to ensure Prabhakar Rao’s return to India. The matter was escalated to the US consulate and the Union Ministry of external affairs for diplomatic intervention. While I-News MD A. Shravan Kumar, who is under scrutiny for the same offence, recently appeared before police for questioning, police disclosed that his passport may also have been revoked. The third phase of investigation is over with the police having gathered all the evidence. Statements of ASP D. Praneet Rao, N. Bhujanga Rao, M. Tirputhanna and retired task force DCP B. Radhakishan Rao exposed serious breaches of privacy and misuse of power. The accused officers revealed that on the instructions of Prabhakar, entire data of Maoists and terrorists was destroyed. Only after confirmation of destruction, Prabhakar fled to the US from Tirupathi. Later, Shravan Rao fled from Bengaluru and joined him in the US, police said. The SIT hopes that Prabhakar has no option now but to return to India. If an individual with a cancelled passport faces an FIR in India, the situation becomes more complex. Moreover, the US’s recent policy of deporting migrants would play a major role in possible extradition of Prabhakar, a police officer said. The FIR may impact the individual’s immigration status in the United States, potentially leading to complications with their green card or visa. Prabhakar tried to seek US government’s assistance due to the change in policies in the U.S. The next step would be to execute the International Arrest Warrant (IAW) which means that the individual can be arrested and detained in any country that is a member of Interpol. There are chances that the Indian government will urge the US to take action, potentially leading to diplomatic efforts to resolve the situation. As per law, Prabhakar cannot challenge the RCN. He may be able to challenge the RCN through Interpol’s commission for the control of Interpol’s files (CCF) or through a court in India only, police said.In the present situation, Prabhakar cannot consult a U.S. attorney to understand the potential risks. He was already involved in multiple crimes and after his apprehension, more people may approach police for justice. The gravity of this case and its constitutional implications indicate that Prabhakar may not be granted bail easily, and he may be detained for extensive custodial interrogation.
