HC upholds sale of small portions at Kukatpally

Hyderabad: The Telangana High Court dismissed a writ petition challenging the auction of 24 stray land parcels in Kukatpally Housing Board (KPHB) Colony, Medchal-Malkajgiri District. Justice T. Vinod Kumar heard a writ plea filed by M/s Phase XV, a welfare association representing homeowners of KukatpallyHousing Board, seeking to nullify the auction notification issued by the housing authorities. The petitioner contended that the auction was illegal and violated the Constitution, as well as a GO dated January 16, 2025, which permits the sale of land parcels below 100 square yards to adjacent homeowners at market value without a public auction. Despite representations made to the authorities, the petitioner alleged that the auction was conducted in disregard of these provisions. Further, it was contended that the auctioned plots had independent access and were not designated as open spaces under the approved layout plan. The judge, upheld the contention that the welfare association could not claim any vested right over the land and was not an aggrieved party. Dismissing the writ petition, the judge imposed a cost of Rs. 10,000/- on the petitioner, payable to the High Court Legal Services Committee within four weeks.
