MUMBAI:  In the Sena-vs-Sena judgment, the Supreme Court has ruled that the Speaker of the Maharashtra assembly should decide the disqualification of 16 MLAs. However, the moot point is the whip of which side – the Eknath Shinde faction or the Uddhav Thackeray side – will be applicable.

Shiv Sena (Thackeray) leader Anil Parab, who is a lawyer, says the Supreme Court made it clear that the legislative party has no right to appoint the whip. Therefore, Shinde-led faction appointed chief whip Bharat Gogawale was not be recognised as the whip.

Parab’s interpretation is that the Uddhav Thackeray-led faction had the right to appoint the whip. “The Speaker must correct his mistake and hear the petitions on the disqualification of the 16 MLAs in the reasonable time period as per the court observations,” said Parab.

Uddhav said the 16 MLAs of the Shinde faction will “go away sooner or later.” He said that as per 10th Schedule of the Constitution, a political party appoints the whip, not its legislative wing. “We expect that the incumbent Speaker has to take up our petition. Otherwise, we would have no options but to again knock the Supreme Court door,” said Uddhav.

“However, the matter is with the Speaker, if he fails to act, then the court will again take up the matter,” Thackeray added. Shiv Sena Lok Sabha MP Rahul Shewale, who belongs to the Shinde-led Shiv Sena, said the Election Commission of India has recognized their faction as the real Shiv Sena so they are a political party.
