Hyderabad: The Telangana High Court on Monday reserved orders in a petition filed by BRS president and former chief minister K. Chandrashekar Rao, and former minister T. Harish Rao, seeking to quash the proceedings initiated by the Jayashankar Bhupalpally district court on a private complaint filed by activist N. Rajalinga Murthy, regarding sinking of Medigadda barrage piers.Murthy, who was murdered last week, had requested the district court that criminal action should be initiated against Chandrashekar Rao, Harish Rao and others, on the grounds of swindling of public money and poor quality in the construction of Medigadda barrage.Based on the private complaint, the district court had issued notices and summonses to the BRS leaders.The High Court had earlier stayed the proceedings of the Bhupalpally district court. With the death of Murthy, the issue has shifted on the subject of effect of the private complaint after the death of the de facto complainant.On the last date of hearing, Justice K. Lakshman had opined that the private complaint had become infructuous and not maintainable as Murthy was dead. However, public prosecutor Palle Nageshwar Rao on Monday furnished some judgments substantiating his contention that the investigation into a case, where the complainant dies in the interim, can be taken up before the judge. Counsel for the BRS leaders opposed the judgments placed by the public prosecutor.Considering the arguments, the court reserved orders in the criminal petition filed by Chandrashekar Rao and Harish Rao.
