A US man is suing Walt Disney Parks and Resorts and Raglan Road Irish Pub & Restaurant after his wife, a doctor, died after eating at the restaurant. The lawsuit by Jeffrey Piccolo alleges that waitstaff at the restaurant was negligent and they were aware of his wife’s deathAccording to a report by CNN, Disney is trying to get the lawsuit “thrown out of court” because he signed up for Disney+ back in 2019. The company reportedly argued that signing up for the streaming service membership means that the user has agreed to arbitrate all disputes with the company.“The Terms of Use, which were provided with the Subscriber Agreement, include a binding arbitration clause. The first page of the Subscriber Agreement states, in all capital letters, that any dispute between You and Us, Except for Small Claims, is subject to a class action waiver and must be resolved by individual binding arbitration,” the company’s motion stated.Piccolo’s lawyers called the company’s response as “outrageously unreasonable and unfair”, as per the report.Piccolo is seeking damages in excess of $50,000 among other things. Last year, Kanokporn Tangsuan, her husband Jeffrey Piccolo and Piccolo’s mother dined at Raglan Road Irish Pub in Disney Springs, which is part of the Walt Disney World resort.The couple was guaranteed by the waiter that certain foods could be made allergen-free but some of the food served was not allergen-free. The waiter assured them that the food was allergen-free but the doctor suffered a severe acute allergic reaction. Despite self-administering an Epi-Pen, Tangsuan died.
