NEW DELHI: In a setback to T Gangi Reddy alias Yerram Gangi Reddy, prime accused in the YS Vivekananda Reddy murder case, the Supreme Court stayed a portion of the Telangana High Court’s order on April 27 directing his release. The High Court had directed the Central Bureau of Investigation (CBI) to release him on July 1, 2023.
A vacation bench, comprising Justices JK Maheshwari and PS Narasimha, ordered re-listing of the case on July 14, 2023. The bench stayed the direction issued in the impugned order, which directed the Court of Principal Special Judge for CBI Cases, Hyderabad, to grant bail to the petitioner on July 1, 2023. Gangi Reddy’s bail was subjected to a personal bond of Rs 1,00,000 with two sureties of the same amount, to the satisfaction of the said court.
The Supreme Court’s order came in response to a plea filed by Vivekananda’s daughter Suneetha Narreddy, challenging the High Court’s decision to cancel the bail of Gangi Reddy. Previously, Gangi Reddy had been granted bail by a court in Pulivendula of Kadapa.
While cancelling his bail, the High Court had directed him to surrender before the CBI investigating the murder case by May 5. It also said that he would be remanded in judicial custody until June 30 following his surrender. Justice Chillakur Sumalatha of the Telangana High Court further mentioned that Reddy could secure bail from the trial court by furnishing a surety of Rs 1.5 lakh.
The CBI, in an affidavit submitted before the Supreme Court, argued that the High Court’s order was pre-judged, pre-empted and encroached upon the power and discretion of the Supreme Court under Article 142 of the Constitution. The affidavit also said that the relief of bail granted in the impugned order was not warranted at the stage of disposal of the petition.
During a previous hearing, a bench led by Chief Justice of India DY Chandrachud expressed dissatisfaction with the High Court’s order, stating, “While cancelling the bail, the High Court says that I am cancelling the bail but he will be released on the 30th.”
