NEW DELHI:  The Shiv Sena faction led by Uddhav Thackeray has moved the Supreme Court against the Election Commission proceedings where CM Eknath Shinde-led group has demanded recognition as the ‘real Shiv Sena.’ The EC has asked the two factions to submit documents by August 8 in support of their claims on the party’s election symbol, bow & arrow.

The papers that the two factions have to submit with the EC include letters of support from the party’s legislative and organizational wings and written statements of rival factions. The fresh plea is a part of a pending petition by Subhash Desai, general secretary of the Shiv Sena, seeking the SC nod to make the poll panel a party in the case.

The Thackeray faction has also written to the poll panel requesting it not to go ahead with Shinde’s plea in view of the pending petitions in SC. The letter calls Shinde’s bid to get the poll symbol and the tag of the real Shiv Sena as an “act of desperation.” 

The Thackeray group filed representation before the EC last week after the Shinde faction of the Shiv Sena had written to the commission seeking allocation of the party’s ‘bow and arrow’ symbol to it. It cited the recognition granted to them in the Lok Sabha and the Maharashtra Assembly. The SC on July 20 said the petitions filed by the Sena and the rebels during the political crisis raised constitutional issues which may require consideration by a larger bench. 

July 11 order extendedThe SC also extended the operation of its July 11 order asking Assembly Speaker not to proceed with a plea seeking disqualification of Thackeray faction MLAs as sought by the Shinde group.
